TERMS OF SERVICE

Subject of the Agreement

StealSeek undertakes to provide the Client with breach intelligence and data leak monitoring services (hereinafter referred to as "StealSeek Services" or "SS") as described in this Agreement. The Client agrees to pay StealSeek the corresponding fees where applicable.

StealSeek provides access to data and intelligence across the surface, deep, and dark web to detect, track, and alert users to compromised or leaked information. The SS may be accessed with limited functionality for free or with expanded features through a paid subscription.

This Agreement becomes binding upon: (i) acceptance of these Terms during signup, (ii) execution of a written contract, or (iii) use of the free version of SS.

Privacy

Free Users

StealSeek offers limited, free-tier access to SS with restrictions on features and data access. StealSeek may terminate or modify free access at any time without notice.

Free users may not:

• Expect warranties, uptime guarantees, or service-level commitments.
• Circumvent protections to access paid features.
• Make automated or bulk data requests without explicit written consent.

Violations may be considered unauthorized access, and StealSeek reserves the right to claim contractual penalties equal to the applicable yearly license fee per violation.

Paid Users

Paid subscriptions offer expanded access to SS as defined in the subscription tier. Upon payment, StealSeek grants the Client a non-transferable license to use SS via the secure platform https://stealseek.io.

Clients must:

• Secure login credentials.
• Prevent unauthorized use by third parties.
• Comply with applicable security and usage practices.

Fees

Clients must pay all fees in advance. Pricing includes VAT where applicable.

• EU clients may be subject to VAT reverse-charge.
• Clients are responsible for disclosing their tax status.
• Fees are non-refundable unless otherwise stated.
• Late payments (7+ days) will accrue 0.1% daily interest.
• StealSeek reserves the right to suspend services until outstanding fees are paid.
• Fees may be adjusted with 30 days' notice.

Warranties and Limitations

• Free-tier services are provided "as-is" without warranties.
• Paid SS subscriptions offer a 95% uptime guarantee per calendar month, excluding maintenance or third-party disruptions.
• Credits may be issued if uptime falls below thresholds.
• StealSeek may schedule maintenance with prior notice or restrict services during force majeure events.
• StealSeek does not track search queries or accessed data unless anonymized for performance optimization.

StealSeek shall not be liable for:

• Accuracy, completeness, or appropriateness of data accessed.
• Decisions made based on SS data.
• Damages, losses, or indirect consequences of using the SS.

Client Responsibilities

• Ensure proper hardware, software, and internet environment.
• Use SS in compliance with all applicable laws.
• Not resell or redistribute SS data.
• Not use StealSeek branding without written permission.

Intellectual Property

This Agreement does not grant the Client any ownership over StealSeek IP or data. All rights are reserved by StealSeek.

Termination

StealSeek may immediately terminate the Agreement if:

• The Client fails to pay fees.
• The Client violates laws, this Agreement, or fair-use policies.
• Unlawful use, abuse, or unauthorized access is detected.

Clients may terminate with immediate effect if StealSeek breaches this Agreement and fails to cure within 14 days of written notice.

Modifications

StealSeek may modify these Terms at any time. Material changes will be notified at least 7 days before taking effect.

Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Hong Kong. Any disputes shall be settled by arbitration in Hong Kong, conducted in English.
